Terms of Service
These terms apply when a studio uses Classfill. “We” and “us” means Jacob Dearle, trading as Classfill (ABN 18 935 045 654). “You” means the studio business that signs up, and the person accepting these terms confirms they can do so for it.
1. The service
Classfill is an online dashboard that turns exports from your booking and sales systems into figures, charts and a monthly report. It reads files you upload. It does not connect to, change or replace your booking system.
2. Free pilot
The founding pilot is free for 30 days from when your account is set up, and no payment details are needed to start. At the end of the pilot you can choose to subscribe. If you don’t, your account simply closes and your data is deleted as described in our Privacy Policy. Pilot features are still being developed and may change, and some importers (currently Momence) are in beta.
3. Subscription, price and cancellation
- After the pilot, Classfill costs $49 a month (Australian dollars), billed monthly in advance through Stripe.
- Founding studios that subscribe at the end of their pilot keep the $49 price for their first 12 months of subscription. After that, we may change the price by giving you at least 30 days’ notice by email, and you can cancel before the change applies.
- You can cancel at any time by emailing jacob@classfill.com.au or through your account. Cancellation takes effect at the end of the month you have already paid for, and you keep access until then. We don’t lock you into a contract.
- Except where the law requires (including the Australian Consumer Law), we don’t refund part-months.
- If a payment fails and isn’t fixed within 14 days of us telling you, we may pause your account until it is.
4. Your data
- You own the data you upload. You give us permission to store and process it only to provide Classfill to you, as described in our Privacy Policy.
- You confirm that you are allowed to share the information in your exports with us for this purpose, and that your own privacy policy or collection notice tells your members their information may be handled by service providers like Classfill.
- Please don’t upload health information (such as injury notes or medical questionnaires) or anything you don’t need us to analyse.
- You can download your reports and ask us to delete your data at any time.
5. Acceptable use
You agree not to:
- upload anything you don’t have the right to share, or anything unlawful or malicious;
- share your login outside your studio’s staff, or try to access another studio’s data;
- try to break, overload, reverse engineer or get around the security of Classfill; or
- resell Classfill or use it to build a competing product.
You are responsible for activity under your studio’s logins. We may suspend access if these terms are seriously breached or the service’s security is at risk, and we will tell you why.
6. Our intellectual property
We own Classfill, including its software, design, calculations and report layouts. You may use the dashboards and reports for your studio’s business, including sharing reports with your team, adviser or accountant. If you send us feedback or ideas, we may use them to improve Classfill without any obligation to you.
7. Figures and written summaries
Classfill calculates its figures from the exports you upload, so results depend on those files being complete and accurate. The written summary in each monthly report is drafted with the help of an AI service from those figures, and may occasionally be incomplete or wrong. Classfill is a tool to help you run your studio. It is not financial, accounting, tax or legal advice, and you remain responsible for your business decisions.
8. Availability and changes
We aim to keep Classfill available and working well, but it may sometimes be unavailable for maintenance, updates or reasons outside our control. We may improve or change features over time. If we make a change that significantly reduces what you’re paying for, we will tell you, and you can cancel. If we ever stop offering Classfill, we will give you at least 30 days’ notice, a chance to download your reports, and a refund of any amount paid for time after it closes.
9. Australian Consumer Law and liability
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, that you have under the Australian Consumer Law or any other law that cannot be excluded.
To the extent the law allows:
- where our liability for failing to meet a consumer guarantee can be limited, it is limited to supplying the service again or paying the cost of having it supplied again;
- our total liability to you in connection with Classfill is limited to the fees you paid us in the 12 months before the claim; and
- we are not liable for indirect or consequential loss, such as lost profits or lost business, or for loss caused by errors in the files you upload.
These limits don’t apply to the extent the loss is caused by our fraud, wilful misconduct, or breach of our privacy obligations.
10. Ending these terms
You can stop using Classfill at any time (section 3). We can end your account with 30 days’ notice, or sooner if you seriously breach these terms and don’t fix the breach within 14 days of us asking. When your account ends, we delete your data as described in our Privacy Policy.
11. Changes to these terms
We may update these terms as Classfill develops. We will email you about significant changes at least 30 days before they apply, and if you don’t agree you can cancel before then.
12. General
These terms are governed by the laws of Western Australia, and the courts of Western Australia have jurisdiction. If any part of these terms can’t be enforced, the rest still applies. Questions about these terms can be sent to jacob@classfill.com.au.
